WHAT IS A CONVEYANCER?
A conveyancer is a licensed professional who specialises in providing advice about the sale of a property. Conveyancers do not necessarily need to be a solicitor, but solicitors often undertake conveyancing work.
It is recommended that you engage in the services of a conveyancer whenever you are:
- buying or selling a property
- subdividing land
- updating a title (i.e. registering a death)
- registering, changing or removing an easement
WHAT DOES A CONVEYANCER DO?
A conveyancer oversees the settlement process of a property so that you can be assured that your sale/purchase is seamless. On the surface it may appear easy, but there are a lot of details, documentation and work that goes in to transferring property from one owner to another.
For a buyer, a conveyancer will:
- Prepare, clarify and lodge legal documents
- Research the property and its certificate of title – check for easements, type of title etc
- Put the deposit money in a trust account
- Calculate the adjustment of rates and taxes
- Settle the property – act on your behalf, advise when the property settles and contact your bank/financial institution when final payments are made
- Represent your interest with the vendor or real estate agent
For a seller, a conveyancer will
- Complete legal documents
- Represent your dealings with the buyer
